Tussle over Tope Alabi's work


FOLLOWING a recent arrest of Mrs. Biodun Ibitola, CEO of Remdel Optimum Communication Limited by the Economic and Financial Crime Commission (EFCC), over reports by Alhaji Tajudeen Bioku, Managing Director of NPC Records that the former is inconsistent with the replication of a work; Angeli Mi, by gospel music artiste, Tope Alabi, Justice O.A. Akinlade of the High Court of Lagos, has in her judgement of April 23, 2012 cleared the former of all allegations, declaring them null and void.
It would be recalled that the Remdel boss had filed a lawsuit restraining Bioku from the violation of her fundamental human rights, via harassment by the EFCC, while also declaring that the demand for the Master Tape of Angeli Mi by Bioku is a gross abuse of power and a violation of Mrs Ibitola's right to property.
Ibitola had argued that her company, Remdel Optimum Communications has a contract with Tope Alabi since 2001 that is still pending when she entered into another contract with Alhaji Bioku. The said contract led to Tope Alabi work 'Angeli Mi'
At a point, Alhaji Bioku had to enter into another marketing agreement with Remdel for a period of three years which the company claimed it faithfully kept until July 13, 2011 when Alhaji Bioku procured the EFCC to arrest and detain Mrs Ibitola.
Alhaji Bioku had claimed that he heard from the grape vine that the album sold two million copies and that she was entitled to a royalty of N140million and consequently enlisted the services of the EFCC to retrieve the money from Mrs Ibitola.
When the EFCC had persistently harassed Mrs Ibitola, she consequently moved to enforce her fundamental Rights as enshrined in the constitution of the Federal Rupublic of Nigeria under Enforcement Procedure Rules of 2009.
Granting all the reliefs sought by the Claimant ( Mrs Ibitola), the trial Judge Hon. Justice Akinlade held that the arrest of the claimant constituted a violation of her right to personal liberty and that the demand for the Master Tape of 'Angeli Mi' constitute a violation of the Claimants right to property.

Granting an injunction restraining the both the EFCC and Bioku from further arrest of the Claimant, the Judge also restrained Alhaji Bioku from forceful seizure or taking the Master Tape of' Angeli Mi' from Mrs Ibitola and also awarded a cost of N50,000 against the respondents.
